This Privacy Policy applies to the Dutch Express LLC and BijBij, LLC (together, the “Company,” “we,” “us,” “our”) website located at https://www.dutchx.com/ (the “Website”), and any applications and other services (collectively, the “Applications” and, together with the Website, the “Services”) to which the Privacy Policy is posted, or any components of the Services, and incorporates by reference the Company’s Terms & Conditions of Use found at https://www.dutchx.com/terms-conditions/. THESE THIRD PARTIES AND SERVICE PROVIDERS MAY INTERCEPT YOUR COMMUNICATIONS, COLLECT DATA ABOUT YOU, MONITOR YOUR INTERACTIONS WITH THE SERVICES, TRACK YOUR ACTIVITIES ON OUR SERVICES AND ACROSS DIFFERENT CHANNELS, AND MAY COLLECT ENOUGH INFORMATION ABOUT YOU AS YOU USE OUR SERVICES TO BE ABLE TO IDENTIFY YOU ON THEIR OWN PLATFORMS (E.G., SOCIAL MEDIAL PIXELS).  BY USING THE SERVICES, YOU SPECIFICALLY CONSENT TO THIS INTERCEPTION, TRACKING AND DATA COLLECTION.

This Privacy Policy is intended to notify you of the Company’s online privacy practices, the types of information that may be collected and stored, with whom the information may be shared, what kind of security procedures are in place to protect the loss, misuse or alteration of information under the Company’s control, and whom to contact with questions or concerns.

This Privacy Policy does not apply to other websites to which the Services may link, and other websites may not treat information collected online in the same manner as the Company does. This Privacy Policy also does not apply to information the Company may obtain from other sources about you.

We collect information when it is provided to or made available to us by a client for us to provide our services to them, when you submit it to us through the Services or by other means (for example, by contacting us through our “Contact” page, or by email, text or telephone). 

Please do not share with us any other person’s personal information (unless the Company explicitly asks you to do so and you have the legal authority to do so), any categories of your own personal information that have not been explicitly requested by the Company, or any confidential, proprietary, secret or legally protected information which you are under any legal obligation to not provide to or share with the Company.

2. We Collect Information Automatically

We automatically collect certain types of information when you use our Services. For example, we automatically collect various types of technical information when you use our Services as otherwise described in this Privacy Policy, including information about the usage and technical efficiencies of our Services, which may include both personal information and non-personably identifiable information (for example, but without limitation, domain type, browser type and version, service provider and IP address, referring/exit pages, operating system, date/time stamp, and click-stream data).

3. We Collect Information from Other Sources

We may obtain information about you from outside sources. For example, if you are an employee of a client of the Company, we may collect information about you from your employer or references. In addition, we may collect information about you from our clients, our affiliates who are providing services to our clients, and our service providers (including software, logistics, shipping, delivery, and data management vendors). 

4. What Personal Information We Collect

We may collect personal or other types of information about you as follows:

1. Publications and Alerts

You may sign up to receive news, updates, or event alerts from the Company. We use this information to communicate with you, to provide you with various communications about news and events that may be of interest to you, and otherwise for business purposes in a manner compatible with the context in which the information is provided to us.

2. Contact

If you communicate with us through our Contact page or otherwise contact us directly, we may ask you to provide personal information in addition to whatever personal information you may otherwise provide to us. We use this information to communicate with you and to respond to any inquiry you make, and otherwise for business purposes in a manner compatible with the context in which you have provided the information to us.

3. General Browsing

Even if you do not submit personal information through the Services as described above, we may gather navigational information about where you and other visitors use the Services and information about the technical efficiencies of our Services (e.g., time to connect to the Services, time to download pages, etc.). In this process of gathering information, we may collect personally identifiable and non-personally identifiable information (for example, but without limitation, domain type, device and browser type and version, browsing behavior, service provider and IP address, region or location where computer or device is accessing the internet, referring/exit pages, operating system, date/time stamp, and click-stream data). We use this information for analysis of the use of our Services and we may also create and use electronic records to compile statistics about how our visitors collectively interact with our Services.

5. Use of Cookies

The Services may use a browser feature known as “cookies.” Cookies are bits of electronic information that a website may transfer to a visitor’s computer to identify specific information about that visitor’s visits to the website. Cookies are typically stored on your computer’s hard drive and are used to help track clicks as you navigate the Services. We, or our third-party providers, may use cookies, for example, to tell us whether you have previously visited the Services. 6. Use of Web Beacons, Clear-GIFs, Pixel Tags and JavaScript

We may use on our Services “web beacons” (also known as “action pixels”, “pixel tags”, or “clear GIFs”), JavaScript plug-ins and/or other similar technologies as they may develop over time. These web beacons and plug-ins are small graphic images (typically that you cannot see) or code on a website or in an email message that are used by third-parties to track the usage of the Services. These devices help us analyze our users’ online behavior and measure the effectiveness of our Services and marketing. We may also work with third-party service providers that help us track, collect, and analyze this information. Third-party entities with whom we have agreements may place these devices on the Services and/or in emails to use information obtained from them such as pages viewed, items purchased, emails opened and items upon which you may click in emails. These third-party providers may also place cookies on your computer to enable us to obtain aggregate demographic information and user statistics about you and your preferences from these third-party sources, as well as information we have about.

7. Server Logs

A “server log” is a record of activity created by a computer that delivers certain webpages to your browser. Certain activities that you perform on our Services may record information in server logs. For example, if you enter a search term into a search box located on the Services, the server log may record the search term(s) you use, or the link you clicked on to bring you to our Services. The server log may also record information about your browser, such as your IP address and the cookies set on your browser. We use this information for analysis of the use of our Services.

8. How We Share Personal Information

  1. We Do Not Sell Personal Information to Third Parties for Their Marketing Purposes
    We do not sell your personal information to/with third parties for their marketing or promotional uses.
  2. We May Share Personal Information on a Limited Basis
    We do not disclose your personal information to unrelated parties outside of the Company except in very limited circumstances. Such disclosures outside of the Company may include disclosures to our agents, vendors, or other contractors who are acting on our behalf and solely at our direction with respect to your personal information, subject to confidentiality obligations, or where we deem it necessary in connection with our services we provide to our clients, or as permitted, required, or authorized by law or by you. For example, we may disclose your personal information to our vendors who help us coordinate shipments to you and communicate with you about your orders. 

    Personal information held by us may also be disclosed in connection with a sale or potential sale of all or part of our business or assets, or if we go through a reorganization or merger, or for any other purpose that complies with applicable law and regulation, including in connection with conflicts checks.

9. Minors

The Services are not directed to or intended for access or use by children. If you are under 18 years of age, please do not access or use the Services at any time or in any manner. Any collection of personal information of minors is inadvertent. 

If you believe we have collected personal information of a child under age 13, please notify us and we will take action to delete it.

10. Security

Our goal is to protect personal information submitted through the Services. We maintain reasonable administrative, physical, and electronic safeguards designed to limit unauthorized access to your personally identifiable information. However, we do not guarantee that our safeguards and security will always work.

11. Your Privacy Rights and Choices

    If you do not consent to the way in which we may use your personal information, please do not submit any personal information to us. Please note that if you opt not to provide us with certain information, we may be unable to provide our services to our clients or make the Services available to you, or our Services may not be as good or effective.

    If you do not wish to receive marketing or other materials from us and/or you do not want us to share your personal information with other entities as stated in this Privacy Policy, please provide us with your exact name and address and advise us that you wish to opt-out for receiving information from us or information sharing or both as the case may be. Please note that de-identified and aggregated data including your personal information may still be shared, but it will not be identified or identifiable to you. Please direct your opt-out request to the contact provided below and include the words “Dutch Express LLC – OPT-OUT REQUEST” in the subject line.
  2. Notice for Individuals Outside of the United States
    If you are using the Services from a location outside of the United States, your connection will generally be through and to servers located in the United States. The Company is United States-based and controls, operates and maintains the Services from its offices within the United States. The Company does not intentionally solicit personal information through the Services from outside of the United States or transmit any personal information obtained through the Services to any location outside of the United States. You should be aware that the data protection laws in the United States may be different from those in your home country. Your continued use of the Services from a location outside of the United States constitutes your agreement that your use of these services is subject to this Privacy Policy and that your personal information will be transferred to or processed in the United States.

We reserve the right to change, modify, add or remove portions of this Privacy Policy at any time. Such changes, modifications, additions or deletions will be posted on the Services. Your continued use of the Services after posting of changes to this Privacy Policy constitutes your binding acceptance of such changes.
